- the brick-and-mortar store at: Okružní 697, 370 01 České Budějovice, Czech Republic
These Terms and Conditions apply exclusively to consumer relationships (B2C) and are issued in accordance with Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended (including Amendment No. 374/2022 Coll.).
By submitting an order, the Buyer confirms that they have read these General Terms and Conditions, including the pre-contractual information and the Complaints Procedure, which form an integral part hereof, and expressly agree to them in the wording valid and effective at the time of placing the order.
Article 2 – Conclusion of the Purchase Contract
1) Online Sales
The presentation of goods in the e-shop is for informational purposes only and does not constitute an offer to conclude a contract.
The purchase contract is concluded upon:
- confirmation of the order by the Seller (usually by e-mail).
The Seller shall deliver the goods no later than 30 days from the conclusion of the contract, unless otherwise agreed. If the Seller fails to deliver within this period, the Buyer may set an additional reasonable deadline; if the Seller fails to deliver even within that additional period, the Buyer has the right to withdraw from the contract.
2) In-store Sales
The purchase contract is concluded upon:
- payment for the goods and their acceptance at the store.
Refusal of Order
The Seller reserves the right to refuse an order, in particular in cases of:
- an obvious pricing error,
- unavailability of goods,
- manifestly incomplete or false information provided by the Buyer.
The Buyer shall be informed of the refusal without undue delay.
Article 3 – Price and Payment Terms
Prices are stated inclusive of VAT and are valid at the moment the order is placed.
Payment Methods
E-shop:
- bank transfer
- online payment card
- cash on delivery
Store:
- cash upon personal collection
- payment card
The goods remain the property of the Seller until full payment of the purchase price. The Seller reserves the right to request a deposit, particularly for custom-made goods.
Article 4 – Delivery and Acceptance of Goods
Goods are delivered by:
- courier service to the Buyer’s address,
- personal collection at the store: Okružní 697, České Budějovice.
Delivery time: usually 2–5 business days.
Condition of Goods upon Delivery
- fully assembled – for in-store collection
- partially assembled (approx. 85%) – for courier delivery; the Buyer is entitled to arrange professional completion of assembly.
The Seller shall not be liable, to the extent permitted by law, for damage caused by improper assembly. The Seller shall not be liable for defects or damage resulting from improper assembly carried out by the Buyer or a third party, unless such defects result from a manufacturing defect (e.g., stripped pedal threads, improperly adjusted gears).
Obligations upon Acceptance
Upon receipt, the Buyer is obliged to:
- check the integrity of the packaging and completeness of the shipment,
- immediately report any visible damage or incompleteness to the carrier and notify the Seller.
The risk of damage passes to the Buyer upon acceptance of the goods.
Article 5 – Liability and Complaints
The Seller is liable for ensuring that the goods are free from defects upon receipt, correspond to the agreed description and quality, and are fit for their usual purpose.
Consumer Rights in Case of Defective Goods
The Buyer is entitled to claim defects within 24 months from receipt (for new goods).
The Buyer primarily has the right to repair or replacement (at their discretion). If repair or replacement is impossible or disproportionate, the Buyer has the right to a reasonable price reduction or withdrawal from the contract.
A defect discovered within 12 months of receipt is presumed to have existed at the time of receipt unless the Seller proves otherwise.
In the case of discounted or used goods, rights to repair, replacement, or price reduction correspond to the nature of the defect and normal wear and tear.
The period for exercising rights begins on the date of receipt. Rights do not apply to defects caused by damage, improper use, or normal wear and tear.
Complaints may be made:
- in person at: Okružní 697, České Budějovice
- by e-mail: info@dirtparade.cz
The Buyer must provide:
- proof of purchase (warranty certificate/invoice/receipt)
- description of the defect (photo/video recommended)
The complaint shall be settled and the Buyer informed of the outcome within 30 days unless agreed otherwise.
Details are set out in the Seller’s Complaints Procedure.
Article 6 – Withdrawal from Contract by the Consumer
1) E-shop
The Buyer has the right to withdraw from the contract within 14 days of receipt without giving any reason.
Withdrawal must be sent to: info@dirtparade.cz (or by post to the store address – model form in Annex No. 1).
The Buyer bears the cost of returning the goods.
Goods must be returned complete, if possible in the original packaging, without unnecessary damage.
The Buyer is liable for any decrease in value resulting from handling beyond what is necessary to establish the nature and characteristics of the goods (e.g., worn tires, scratches). The Seller may deduct restoration costs.
The Seller shall refund the purchase price including the cheapest offered delivery cost within 14 days, but not before receiving the returned goods.
The right of withdrawal does not apply to customized or made-to-order goods.
2) In-store Sales
The statutory right of withdrawal without reason does not apply to in-store purchases. Returns are only possible upon individual agreement.
Article 7 – Personal Data Protection
Processing is carried out in accordance with the GDPR (EU) and Act No. 110/2019 Coll.
Data are processed for contract performance and marketing purposes only based on consent.
The Buyer has the right to access, rectification, erasure, and restriction of processing.
Consent for marketing may be withdrawn at any time via e-mail or the unsubscribe link in newsletters.
Article 8 – Warranty Conditions
The Seller provides a quality guarantee for 24 months from receipt, without prejudice to statutory rights.
The warranty does not cover:
- normal wear and tear of consumables (chain, cassette, brake pads, grips, tires, tubes, saddle, etc.),
- defects caused by improper use or failure to follow manufacturer instructions,
- defects caused by unauthorized intervention or modification,
- use of non-original or incompatible parts,
- damage caused by impact, accident, or overloading,
- force majeure events,
- racing or freeride use beyond the model’s intended purpose.
Article 9 – Initial Service Inspection
To ensure safe operation and long service life, the Buyer (for both e-shop and store purchases) is required to undergo an initial service inspection within 2 months or 300 km.
The inspection includes bolt tightening, gear and brake adjustment after the break-in period.
Failure to undergo inspection may affect complaint assessment only if demonstrably linked to the defect. This does not affect statutory rights.
Article 10 – Alternative Dispute Resolution
In the event of a dispute, the Buyer may contact:
Czech Trade Inspection Authority (ČOI)
Štěpánská 44, 110 00 Prague 1
Website: adr.coi.cz
E-mail: adr@coi.cz
ADR is free of charge; each party bears its own costs.
Article 11 – Final Provisions
These Terms are valid and effective as of 1 May 2026.
They are governed by the laws of the Czech Republic.
The Buyer confirms having read them prior to contract conclusion.
The Seller reserves the right to amend the Terms; amendments do not affect contracts concluded before their effectiveness.
If any provision is invalid, the remaining provisions remain unaffected.
Disputes shall be resolved by the competent courts of the Czech Republic.
